Q: I’ve been out of work since the pandemic began, and have been receiving unemployment benefits. I’ve never had to show that I’m looking for work — and I am looking — but I heard the Unemployment Insurance Agency now wants people to submit some kind of record. What kind of proof do I need?

A: If you haven’t already started submitting a record of your job search when you certify for unemployment benefits, you may already be in trouble.

As of May 30, work search requirements, which had been suspended since March 2020, have been reinstated. Every week, you must engage in and document at least one “work search activity.” Beginning with the weeks ending June 5 and June 12, you were required to provide proof of your job search when you certified for benefits. If you do not provide this information for any week, you will not be eligible for benefits for that period.

The requirement was reinstated based on fears that beefed up benefits are discouraging unemployed workers from looking for work and contributing to a shortage of qualified workers. The validity of those fears has been disputed, but employers, especially those in the restaurant and hospitality industries, have complained they cannot find workers.

Work-search activities include applying for jobs in person or online, putting your résumé on a professional networking or job site like MiTalent.org or LinkedIn, or attending a job fair or workshop. When you certify for benefits, you must list the name and date of each activity, the name and address of the employer/organization/job fair etc., and the method of contact (online, in person, etc.).

The Unemployment Agency may later ask you to provide documentation of your efforts to find a job — and something more than a handwritten note is needed. For instance, you could document an online search with a screenshot of your application; documentation of attendance at a job fair could include a copy of your registration and, if possible, your signature on the sign-in sheet.

You should keep a folder of all your work search and documentary support for at least three years. In certain cases, the agency has up to three years to review a claim — even if the claimant has exhausted benefits and/or found a job.

Recently, hundreds of claimants who applied for and received benefits under the CARES Act in March and April 2020 have been asked to pay back thousands of dollars after the agency belatedly determined they were never eligible for benefits in the first place. Some examples are claimants being physically unable to work, claiming benefits as a freelancer without proof that they ever made a living from such work or claiming benefits in Michigan based on losing a job performed in another state.

Some work search activities can be used only sparingly. For example, setting up a new account with Indeed, LinkedIn, MiTalent.org, or Monster can only be used once in a benefit year. Once registered, you can use each site as part of your work-search activities only once a month — so you may want to register for several job sites.

If you are not registered with the state’s online site, Mi-WAM, now is a good time to register. Details of your job search can be easily added after you complete the online certification questions every two weeks. While the UIA advises people who certify over the phone that they can continue to do so — just by staying on the phone to speak with an agent after answering the automated questions — there have been reports that the system did not work well. After completing the questions, the claimant waited and waited … and waited … but no agent came on the line. Unfortunately for people certifying by phone, the certification is incomplete until a claimant speaks to an agent and provides job-search information, and the claimant will be ineligible to receive benefits for that period.

Some workers may be eligible for a waiver of the work-search requirement for reasons related to COVID-19, such as having been advised by a medical professional to self-isolate or quarantine.

Michigan activates extended unemployment insurance benefits

LANSING — The Michigan Unemployment Insurance Agency has announced that the unemployment insurance benefits period has been lengthened under the Federal Extended Benefits program.

The UIA implements the EB program that pays unemployment benefits during periods of high unemployment to workers who exhausted their basic entitlement to regular state and federal Pandemic Emergency Unemployment Compensation benefits. EB is a program that provides an extension of benefits to those who can establish/have established a state unemployment claim.

EB provides up to 20 weeks of additional benefits to workers who have exhausted their regular benefits (26 weeks maximum) and PEUC (13 weeks). Primarily federally funded, the EB program kicks in when the state’s unemployment rate averages 8% or higher for three consecutive months.

“The Extended Benefit program will provide a much-needed safety net for Michiganders who have exhausted their current benefits and are still dealing with the long-term effects of unemployment due to COVID-19,” said UIA Director Steve Gray.

Eligibility for EB will be determined in the same manner as regular unemployment benefits. Claimants must be unemployed or underemployed and be able to work and available for work. The program’s weekly benefit amount is the same as the individual received for regular state unemployment insurance. Claimants can expect to be notified through their chosen communication method of the extension. They must continue to file their bi-weekly certification and will not need to complete a separate application.

Work Share

The State’s Work Share program continues to support the economy by helping employers who are still experiencing decreases in customer demand supplement their payroll. Since March 15, the program has helped preserve the state trust fund by providing $465 million in federal benefits to workers. Michigan’s Work Share program was first in the nation during COVID-19 with more than 2,500 Michigan employers and nearly 97,000 employees enrolled at the peak of the pandemic.

Paying Unemployment Claims

Since March 15, nearly 2.3 million certifying, potentially eligible claimants have applied for state and federal benefits, with nearly $24 billion in benefits paid to 2.2 million workers, or roughly 96% of potentially eligible, certifying claimants. There are currently around 80,000 claimants needing ID verification and around 13,000 in the adjudication process which requires a one-on-one review of their claim.

Recently unemployment agencies across the country have observed a significant uptick in attempted fraudulent activity coinciding with the implementation of the Lost Wages Assistances program which provided an additional $300 in weekly benefits from July 26 to Sept. 5, 2020.

The higher supplemental benefit attracts additional criminal attention and unemployment agencies across the country remain under attack. These cases have been flagged for identity verification to prevent payment and have increased the number of claimants needing ID verification from around 28,000 to 80,000 over the last two weeks.

The UIA continues to work to prevent criminals from stealing benefits and is also partnering with Attorney General Dana Nessel’s task force and state and federal partners to identify alleged fraud that can be quickly turned over to law enforcement for prosecution.

When an individual files a claim for unemployment insurance, they will receive a written Monetary Determination letter. New scam targets Michigan residents collecting unemployment benefits

(WXYZ) — Michigan Attorney General Dana Nessel is warning residents of a scam taking advantage of claimants who are collecting unemployment benefits.

Claimants are receiving an email from a Gmail account that appears to be from the Unemployment Insurance Agency asking for personal information. The scammer is also attaching what looks like an actual communication from the UIA in an apparent effort to strengthen the credibility of the email.

“There is no government agency, state or federal, that uses Gmail for official purposes,” Nessel said, noting the scammer’s email address. “Michigan residents should always examine the full email address if the sender is requesting their personal information.”

If you received this email, do not respond. Responses to ID verification requests from UIA should only be uploaded through your secure Michigan Web Account Manager (MiWAM) account online at the UIA’s website.

Anyone who has fallen for this scam should immediately Report Fraud or Identity Theft with the UIA. They should also monitor their banking and account information each time they certify for benefits.

“Bad actors are increasingly sophisticated in their efforts to deceive people into giving away personal information,” said Nessel. “This is one of the cruelest scams I’ve ever seen because it targets vulnerable residents who are desperate to receive their UIA benefits – so desperate that they may not inspect the email address to confirm its validity.”

These 26 States Are Still Offering $300 LWA Unemployment Benefits Boost

If you’re unemployed, you may be getting a financial boost from the federal government through the Lost Wages Assistance (LWA) program. While the LWA program will end on Dec. 27, president-elect Joe Biden will enter the White House in Jan. 2021, raising hopes that there will be another stimulus bill with additional federal unemployment support.

For now, only a couple dozen states are paying LWA benefits as many have already distributed their funds.

The LWA program allots $300 per week per qualifying applicant in federal aid, typically for 3 to 6 weeks; states can optionally add another $100. Each state was required to apply for the funding. Most applied and were approved for federal assistance, except South Dakota, who declined the funding without applying. Most states declined to add the $100-a-week state benefit on top of the federal allowance, with many stating.

Unfortunately, not all unemployed Americans will qualify for this enhanced benefit. Residents in approved states must have received at least $100 per week in unemployment benefits prior to the week ending in Aug. 1 to be eligible for LWA, and provide self-certification that the unemployment is due to disruption caused by the pandemic.

What’s Next For Unemployment Benefits?

Michigan activates extended unemployment insurance benefits

LANSING — The Michigan Unemployment Insurance Agency has announced that the unemployment insurance michigan uia online certification period has been lengthened under the Federal Extended Benefits program.

The UIA implements the EB program that pays unemployment benefits during periods of high unemployment to workers who exhausted their basic entitlement to regular state and federal Pandemic Emergency Unemployment Compensation benefits. EB is a program that provides an extension of benefits to those who can establish/have established a state unemployment claim.

EB provides up to 20 weeks of additional benefits to workers who have exhausted their regular benefits (26 weeks maximum) and PEUC (13 weeks). Primarily federally funded, the EB program kicks in when the state’s unemployment rate averages 8% or higher for three consecutive months.

“The Extended Benefit program will provide a much-needed safety net for Michiganders who have exhausted their current benefits and are still dealing with the long-term effects of unemployment due to COVID-19,” said UIA Director Steve Gray.

Eligibility for EB will be determined in the same manner as regular unemployment benefits. Claimants must be unemployed or underemployed and be able to work and available for work. The program’s weekly benefit amount is the same as the individual received for regular state unemployment insurance. Claimants can expect to be notified through their chosen communication method of the extension. They must continue to file their bi-weekly certification and will not need to complete a separate application.

Work Share

The State’s Work Share program continues to support the economy by helping employers who are still experiencing decreases in customer demand supplement their payroll. Since March 15, the program has helped preserve the state trust fund by providing $465 million in federal benefits to workers. Michigan’s Work Share program was first in the nation during COVID-19 with more than 2,500 Michigan employers and nearly 97,000 employees enrolled at the peak of the pandemic.

Paying Unemployment Claims

Since March 15, nearly 2.3 million certifying, potentially eligible claimants have applied for state and federal benefits, with nearly $24 billion in benefits paid to 2.2 million workers, or roughly 96% of potentially eligible, certifying claimants. There are currently around 80,000 claimants needing ID verification and around 13,000 in the adjudication process which requires a one-on-one review of their claim.

Unemployment Fraud

Recently unemployment agencies across the country have observed a significant uptick in attempted fraudulent activity coinciding with the implementation of the Lost Wages Assistances program which provided an additional $300 in weekly benefits from July 26 to Sept. 5, 2020.

The higher supplemental benefit attracts additional criminal attention and unemployment agencies across the country remain under attack. These cases have been flagged for identity verification to prevent payment and have increased the number of claimants needing ID verification from around 28,000 to 80,000 over the last two weeks.

The UIA continues to work to prevent criminals from stealing benefits and is also partnering with Attorney General Dana Nessel’s task force and state and federal partners to identify alleged fraud that can be quickly turned over to law enforcement for prosecution.

Protect Against Unemployment ID Theft

When an individual files a claim for unemployment insurance, they will receive a written Monetary Determination letter. If you receive this letter (Form UIA 1575C) and you have not applied for unemployment benefits, or the name on the form is not yours, you may be a victim of identity theft. Q: I’ve been out of work since the pandemic began, and have been receiving unemployment benefits. I’ve never had michigan uia online certification show that I’m looking for work — and I am looking — but I heard the Unemployment Insurance Agency now wants people to submit some kind of record. What kind of proof do I need?

A: If you haven’t already started submitting a record of your job search when you certify for unemployment benefits, you may already be in trouble.

As of May 30, work search requirements, which had been suspended since March 2020, have been reinstated. Every week, you must engage in and document at least one “work search activity.” Beginning with the weeks ending June 5 and June 12, you were required to provide proof of your job search when you certified for benefits. If you do not provide this information for any week, you will not be eligible for benefits for that period.

The requirement was reinstated based on fears that beefed up benefits are discouraging unemployed workers from looking for work and contributing to a shortage of qualified workers. The validity of those fears has been disputed, but employers, especially those in the restaurant and hospitality industries, have complained they cannot find workers.

Work-search activities include applying for jobs in person or online, putting your résumé on a professional networking or job site like MiTalent.org or LinkedIn, or attending a job fair or workshop. When you certify for benefits, you must list the name and date of each activity, the name and address of the employer/organization/job fair etc., and the method of contact (online, in person, etc.).

The Unemployment Agency may later ask you to provide documentation of your efforts to find a job — and something more than a handwritten note is needed. For instance, you could document an online search with a screenshot of your application; documentation of attendance at a job fair could include a copy of your registration and, if possible, your signature on the sign-in sheet.

You should keep a folder of all your work search and documentary support for at least three years. In certain cases, the agency has up to three years to review a claim — even if the claimant has exhausted benefits and/or found a job.

Recently, hundreds of claimants who applied for and received benefits under the CARES Act in March and April 2020 have been asked to pay back thousands of dollars after the agency belatedly determined they were never eligible for benefits in the first place. Some examples are claimants being physically unable to work, claiming benefits as a freelancer without proof that they ever made a living from such work or claiming benefits in Michigan based on losing a job performed in another state.

Some work search activities can be used only sparingly. For example, setting up a new account with Indeed, LinkedIn, MiTalent.org, or Monster can only be used once in a benefit year. Once registered, you can use each site as part of your work-search activities only once a month — so you may want to register for several job sites.

If you are not registered with the state’s online site, Mi-WAM, now is a good time to register. Details of your job search can be easily added after you complete the online certification questions every two weeks. While the UIA advises people who certify over the phone that they can continue to do so — just by staying on the phone to speak with an agent after answering the automated questions — there have been reports that the system did not work well. After completing the questions, the claimant waited and waited … and waited … but no agent came on the line. Unfortunately for people certifying by phone, the certification is incomplete until a claimant speaks to an agent and provides job-search information, and the claimant will be ineligible to receive benefits for that period.

Some workers may be eligible for a waiver of the work-search requirement for reasons related to COVID-19, such as having been advised by a medical professional to self-isolate or quarantine.

Each year, Unemployment Insurance (UI) must certify to the Internal Revenue Service (IRS) the Michigan
employers that have paid their state unemployment taxes in full and on time, in order for the employers to receive a
credit against the tax assessed by the IRS under the Federal Unemployment Tax Act (FUTA).
Because of the unique “co-employer” relationship between a Professional Employer Organization (PEO)
(sometimes known as an “Employee Leasing Company,” or “ELC”) and its client entities, either the PEO or its
client entities (but not both) may be entitled to the FUTA tax credit. The IRS has directed UI that the FUTA tax
credit must be issued to whichever of the two co-employers (PEO or client entities) is in control of the payment of
the wages to the leased employees. Specifically, the IRS has provided guidance that UI must determine whether the
PEO’s payment of wages is based upon one of two business and/or contractual arrangements:
In the first arrangement, a PEO’s payment of wages is based upon it first receiving funds from the client for paying
wages to the leased employees. Under this arrangement, the federal guidance provides that the client entity would
be certified by UI to receive the FUTA credit. If this business arrangement describes your business practice, it is
not necessary for the PEO to complete this Form; in such instances, the client entities named on page 2 of this
Form will receive the FUTA certification.
In the second arrangement, UI must make a finding that the PEO is being reimbursed by the client entity after the
wages are paid to the leased employees. Under this arrangement, the federal guidance provides that the PEO is in
control of the wages and, therefore, entitled to the FUTA certification credit. If this business arrangement describes
your business practice, and the PEO seeks the credit, then, to ensure an accurate finding by UI, the PEO must
provide to UI, not later than November 30 of any year (to be effective for the 940 certification due to the IRS
by the following January 31), a completed copy of this Form, including page 2, signed below by an owner, officer,
